Sonorous Terms of Service

Introduction

Welcome to Sonorous (the "App"). These Terms form an agreement between you and Yangben Cloud (Shanghai) Network Technology Co., Ltd. ("we", "us") governing your use of the App.

Please read these Terms in full before using the App. By registering, signing in or otherwise using the App, you are deemed to have fully understood and agreed to all of these Terms. If you do not agree with any part of them, please do not use the App.

1. Definitions

  1. The App: the Sonorous mobile client software and its corresponding server-side services.
  2. User: a natural person who registers, signs in or otherwise uses the App.
  3. User content: text, links and files submitted, uploaded or imported by a user through the App, and the audio derived from them.
  4. Service: the functions we provide to users through the App, including web article extraction, speech synthesis, audio playback and listening list management.

2. Account registration and use

  1. You may register an account with an email address or mobile phone number. You must ensure that the registration information you provide is true, accurate, complete and lawful.
  2. If your registration information changes, you should update it promptly. You are responsible for any consequences of registration information that is untrue or inaccurate.
  3. Accounts are for your own use only. You may not lend, transfer, rent or otherwise make your account available to others.
  4. You must keep your account and password secure. You are responsible for any loss arising from your failure to do so. If you discover that your account is being used unlawfully, you should notify us immediately.

3. The service

  1. The core function of the App is to convert a web link or text you provide into audio that you can listen to.
  2. For pages whose article body cannot be extracted directly by our servers, the App provides an optional on-device loading method that you initiate yourself.
  3. The App provides resume-from-where-you-stopped playback, listening history and favourites. The exact feature set depends on the version you are using.
  4. We may adjust, add or remove features as operational needs require. We will give advance notice of material changes.

4. Acceptable use

When using the App, you must not:

  1. submit, upload or distribute content that violates the laws and regulations of the People's Republic of China
  2. submit, upload or distribute content that infringes the intellectual property, reputation, privacy or other lawful rights of others
  3. crack, decompile or reverse engineer the App through technical means, or circumvent usage limits or access controls
  4. use automated programs to submit content in bulk, register accounts in bulk, or otherwise interfere with the normal operation of the service
  5. use the App for any unlawful or unauthorised purpose

If you breach these rules, we may, depending on the severity, restrict features, suspend or terminate your account, and we reserve the right to pursue legal remedies.

5. Intellectual property

  1. The intellectual property in the App's software, interface design, icons, word marks and related materials belongs to us or the relevant rights holders.
  2. Intellectual property in content you submit through the App belongs to you or the original rights holder. You must ensure that you hold lawful rights to, or have been authorised to use, the content you submit.
  3. To deliver the functions described in these Terms, you grant us a licence to process the content you submit to the extent necessary. That licence is limited to the scope required to provide the service.
  4. Audio generated by the App is for your personal listening only. It may not be used for commercial distribution, redistribution or public playback.

6. Fees and in-app purchases

  1. The basic features of the current version are free to use. There is no subscription or in-app purchase.
  2. An advanced edition will be introduced in later releases. Its contents, pricing and effective date will be published in the App and announced before they take effect.
  3. If paid features are introduced, all payments will be made through Apple App Store in-app purchase. We do not process your payment information directly.
  4. If a purchase is made, automatic renewal, cancellation and refunds follow Apple App Store rules. You can manage or cancel automatic renewal in your Apple account settings.
  5. If you dispute a purchase, you may first apply for a refund through Apple's process, and you may also contact us to help investigate.

7. Changes, interruption and termination of the service

  1. We will make reasonable efforts to keep the service available, but we do not guarantee uninterrupted service. We are not liable for interruptions caused by device failure, network problems, third-party service failure or force majeure.
  2. To maintain the security and quality of the service, we may perform scheduled or unscheduled maintenance, during which some features may be unavailable.
  3. If you seriously breach these Terms, we may terminate your access to the service.
  4. You may close your account and stop using the App at any time.

8. Disclaimer and limitation of liability

  1. The App is provided on the basis of the technology available at the time. We do not guarantee that results will be entirely accurate, timely or reliable.
  2. The results of extracting content from third-party web pages depend on the structure of those pages. We are not responsible for the completeness of extraction results.
  3. To the maximum extent permitted by law, we are not liable for indirect, incidental or punitive losses arising from your use of, or inability to use, the App.
  4. If our liability cannot be excluded entirely, our total compensation is limited to the amount you actually paid us in the twelve months before you made the claim.
  5. This section does not exclude liability that cannot be excluded or limited under mandatory provisions of law.

9. Minors

If you are a minor under the age of fourteen, you should read these Terms together with your guardian and use the App only with your guardian's consent. Your guardian should guide you in using the App correctly and bears corresponding responsibility.

10. Changes to these Terms

We may revise these Terms from time to time. The revised version will be published on this page. If a change materially affects your rights or obligations, we will draw attention to it prominently. If you do not agree with a change, you should stop using the App. Continued use is taken as acceptance of the revised Terms.

11. Governing law and dispute resolution

The formation, performance and interpretation of these Terms are governed by the laws of the People's Republic of China. Disputes arising from these Terms should be resolved through friendly negotiation. If negotiation fails, either party may bring proceedings before a court of competent jurisdiction.
